Purpose & Scope
These Terms apply to all hosting, pipeline storage, and cloud infrastructure services provided directly or indirectly by ITX Digital Services (PVT) LTD to the Client.
These Terms shall be strictly governed by and construed in accordance with the laws of Sri Lanka.
Company-Provided Hosting and Servers
- • The Company shall provide hosting and server setups only as explicitly agreed upon within a formal written contract.
- • Ecosystems hosted on infrastructure owned, leased, or directly managed by the Company may be eligible for recurring automated backup pipelines, continuous system monitoring, and fundamental security protections, subject directly to the package chosen.
- • Notice: The Company does not guarantee completely uninterrupted service uptimes, absolute file data integrity, or complete fortress protection against all emerging forms of technical failure or malicious cyber threats.
Website Data Backups
Backup snapshots are created, stored, and systematically maintained only for web applications hosted directly on server networks provided and fully managed by the Company. Backup intervals, data retention lifetimes, and system restoration capabilities are completely determined by your selected service plan.
The Company shall not be held liable for recovering blocks of data not captured inside standard logs, or data modified prior to the most recent successful backup run. Absolutely no backup services, manual re-backups, or technician restoration support will be deployed for web assets deployed on independent third-party server environments.
Third-Party Hosting Platforms
Where the Client opts to run core systems on independent third-party server providers, those environments remain outside the technical control and responsibility of the Company.
- The Company is completely exempt from liability for server downtimes, service interruptions, database corruption issues, or performance drops stemming from third-party networks.
- Backup strategies, structural disaster recovery setups, and systematic troubleshooting interventions linked to third-party architectures are the exclusive operational duty of the Client and the respective third-party company.
Security Implementation Responsibilities
Limited operational perimeter security routines are conducted exclusively for hosting environments managed directly by the Company, pursuant to explicit tier provisions.
The Client formally acknowledges total responsibility for establishing and maintaining appropriate compliance frameworks, custom endpoint security mechanisms, and localized privacy tools on non-managed nodes.
Limitation of Liability Framework
To the maximal degree allowed under standard enforceable statutes, the Company stays completely exempt from direct or indirect losses, damages, or claims resulting from:
